Tokyo Processus des huissiers de justice
Tokyo process servers serve judicial and non-judicial documents related to civil and commercial matters under the authority given to them by the Code of Civil Procedures or pursuant to the Hague Service Convention (Convention of 15 November 1965). Service of documents originating within Japan and getting served within Japan are served according to Japan’s Code of Civil Procedures. Documents originating in another country and getting served in Japan, are served under the Hague Service Convention or via Letters Rogatory while complying with the requirements of Japan’s Code of Civil Procedures.

Japan’s position on Hague Service Convention (Convention of 15 November 1965)
The Convention of 15 November 1965 on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters (HCCH 1965 Service Convention) provides for the channels of transmission to be used when a judicial or extrajudicial document is to be transmitted from one Contracting Party to the Convention to another Contracting Party for service in the latter. It establishes a main channel of transmission via a designated Central Authority, as well as alternative channels of transmission.
Hague Service Convention deals primarily with the expedient transmission of documents; it does not address or comprise substantive rules relating to the actual service of process. The framework provided by the Convention is both efficient and effective – statistical data shows that 75% of requests are executed within two months.
Japan is a signatory to the Hague Service Convention (Convention of 15 November 1965). The department responsible for the international judicial cooperation for the purpose of Hague Service Convention is the Ministry of Foreign Affairs.
As Japan is a signatory to the Hague Service Convention, this is often the most straightforward method for serving legal documents from a foreign country. Our team facilitates the proper submission of documents to the Japanese Central Authority, ensuring compliance with the Convention’s regulations. While this method is reliable and recognized globally, it can take several months to complete, depending on the complexity of the case.
Japan objects to service under Articles 10(a), 10(b), and 10( c ) within its territory.
Japan’s position on Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters
In civil or commercial matters, a judicial authority of a Contracting State may, in accordance with the provisions of the law of that State, request the competent authority of another Contracting State, by means of a Letter of Request, to obtain evidence, or to perform some other judicial act. A Letter shall not be used to obtain evidence which is not intended for use in judicial proceedings, commenced or contemplated. The expression “other judicial act” does not cover the service of judicial documents or the issuance of any process by which judgments or orders are executed or enforced, or orders for provisional or protective measures.
Japan is not a signatory to the Hague Evidence Convention (Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters).
Transmission of Letters of Requests
For cases where the Hague Service Convention is not applicable, or when more formal channels are required, Commission rogatoire is a viable alternative. This diplomatic method involves formal requests from the courts of one country to the courts of Japan for assistance in serving legal documents. Though more time-consuming, this method ensures full adherence to Japan’s judicial processes and is often used in complex legal disputes.
