Service of documents originating within Netherlands and getting served within Netherlands are served according to Netherlands’ Code of Civil Procedures.

Documents originating in another country may be served in the Netherlands pursuant to the Hague Service Convention where the Convention applies. Requests transmitted through the Convention’s main channel are submitted to the Dutch Central Authority, which arranges for service in accordance with the applicable Dutch procedure.

Personal service by a Dutch bailiff is required only where the addressee resides within the Netherlands, since a bailiff’s authority to serve documents does not extend beyond Dutch territory.

The Hague Convention provides various modes of process service of documents such as by postal channel or by diplomatic/consular agents, judicial officers, officials, or other competent persons. These provisions are covered under Articles 8 to 10 and may or may not be allowed by member countries as a valid mode of serving the documents in their territory. Serving the documents through the Central Authority (Article 5) is not optional but is binding on all the member countries. Services done by the Central Authority usually take a long time: 2 to 12 months. Note that the convention gives relief to the litigants if they have not received a certificate of service or delivery from the Central Agency even after waiting for six months. In such cases, the Court may, if it considers that a reasonable time has elapsed, give its judgment. Also, in case of urgency, the court may issue a provisional order or protective measure even before the six-month waiting period.

Service by mail is possible only in states that have not objected to that method under Article 10(a) of the Hague Service convention and if the jurisdiction where the case originates allows it under its applicable law. The Netherlands does not object to the alternative channels of transmission provided under Article 10 of the Hague Service Convention. Accordingly, judicial documents may be sent directly to an addressee in the Netherlands through postal channels under Article 10(a), subject to the applicable requirements of the Convention and the law of the jurisdiction where the proceedings originate.

THE NETHERLANDS’ POSITION ON THE HAGUE SERVICE CONVENTION (CONVENTION OF 15 NOVEMBER 1965)

The Convention of 15 November 1965 on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters (HCCH 1965 Service Convention) provides for the channels of transmission to be used when a judicial or extrajudicial document is to be transmitted from one Contracting Party to the Convention to another for service in the latter. It establishes a main channel of transmission via a designated Central Authority, as well as alternative channels of transmission.

Hague Service Convention deals primarily with the expedient transmission of documents; it does not address or comprise substantive rules relating to the actual service of process. The framework provided by the Convention is both efficient and effective – statistical data shows that 75% of requests are executed within two months.

Netherlands is a signatory to the Hague Service Convention (Convention of 15 November 1965). The department responsible for the international judicial cooperation for the purpose of Hague Service Convention is the Public Prosecutor at the District Court of The Hague (De Officier van Justitie).

Netherlands does not object to service under Articles 10(a), 10(b), and 10(c) within its territory.

Netherlands’s position on Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters

In civil or commercial matters, a judicial authority of a Contracting State may, in accordance with the provisions of the law of that State, request the competent authority of another Contracting State, by means of a Letter of Request, to obtain evidence, or to perform some other judicial act. A Letter shall not be used to obtain evidence which is not intended for use in judicial proceedings, commenced or contemplated. The expression “other judicial act” does not cover the service of judicial documents or the issuance of any process by which judgments or orders are executed or enforced, or orders for provisional or protective measures.

Netherlands is a signatory to the Hague Evidence Convention (Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters). The department responsible for the international judicial cooperation for the purpose of Hague Evidence Convention is the District Court in The Hague. For Aruba: The Attorney-General at Aruba of the Joint Court of Justice of Aruba, Curaçao, Sint Maarten and of Bonaire, Sint Eustatius and Saba.

Transmission of Letters of Requests

Letters of Request are first sent to the Central Authority of the requesting state, before being sent to the Central Authority of Netherlands. The Letters of Request (formally known as Letters Rogatory) are sent by the requesting state via diplomatic channels to Netherlands’s central authority. Letters of Request will be accepted in Dutch, German, English or French, or if they are accompanied by a translation into one of these languages. The Netherlands does not undertake to translate documents for the execution of a Letter of Request.

The Netherlands is a party to the Hague Service Convention, under which formal service is carried out in accordance with Dutch law through the Dutch Central Authority. INFORMAL SERVICE

Service effected through the alternative channels available under Article 10 is just as legally valid and effective as service completed through the Central Authority under Article 5 of the Hague Service Convention. The Netherlands permits service through the following alternative channels: Article 10(a) allows judicial documents to be sent directly to persons abroad through postal channels; Article 10(b) allows judicial officers, officials, or other competent persons of the State of origin to transmit documents directly for service through judicial officers, officials, or other competent persons of the Netherlands; and Article 10(c) allows any person interested in a judicial proceeding to arrange for service directly through judicial officers, officials, or other competent persons in the Netherlands. Use of these channels remains subject to any applicable requirements of Dutch law and the circumstances of the particular case.

The Netherlands does not require a Dutch translation of documents submitted through its Central Authority. However, a Dutch or English translation of the document summary is recommended to facilitate efficient service.
