重排服务条例

Scope

This Regulation applies to the cross-border service of judicial and extrajudicial documents in civil or commercial matters between EU Member States. It does not apply to:

• Revenue, customs, or administrative matters.

• The liability of a Member State for actions or omissions in the exercise of state authority (acta iure imperii).

• Cases where the address of the person to be served is unknown.
  
  

Application

To apply the Regulation:

1. Transmission: A legal practitioner or court submits a service request to the Central Authority in the Member State where the document is to be served.

2. Service Methods: The Central Authority arranges for the document to be served using local judicial officers, postal services, or other authorized means.

3. Proof of Service: Once served, the Central Authority returns proof of service to the requesting party, ensuring legal validity.

4. Alternative Methods: If service under the Regulation is not possible or appropriate, alternative methods such as the Hague Service Convention 或 司法协助请求书 may be considered.
