Belgium process servers serve judicial and non-judicial documents related to civil and commercial matters under the authority given to them by the Code of Civil Procedures or pursuant to the Hague Service Convention (Convention of 15 November 1965). Service of documents originating within Belgium and getting served within Belgium are served according to Belgium’s Code of Civil Procedures. Documents originating in another country and getting served in Belgium, are served under the Hague Service Convention or via Letters Rogatory while complying with the requirements of Belgium’s Code of Civil Procedures.
La Convention de La Haye est un traité multilatéral adopté à La Haye, aux Pays-Bas, le 15 novembre 1965, par les États membres de la Conférence de La Haye du droit international privé. Cette convention a été créée afin de fournir aux parties et aux autres personnes intéressées un moyen fiable, économique et efficace de remettre des documents aux parties résidant ou exerçant leurs activités dans un autre pays.
Méthode de service

Méthodes alternatives de service
La Convention de La Haye prévoit divers modes de notification des documents, tels que par voie postale ou par des agents diplomatiques ou consulaires, des agents judiciaires, des fonctionnaires ou d’autres personnes compétentes. Ces dispositions sont régies par les articles 8 à 10 et peuvent ou non être autorisées par les pays membres comme mode valide de notification des documents sur leur territoire.
La transmission des documents par l’Autorité centrale (article 5) n’est pas facultative mais est obligatoire pour tous les pays membres. Les services fournis par l’Autorité centrale prennent généralement beaucoup de temps : de 2 à 12 mois. Veuillez noter que la convention prévoit une dérogation pour les parties si elles n’ont pas reçu de certificat de notification ou de livraison de la part de l’Autorité centrale, même après avoir attendu six mois.
Dans de tels cas, le tribunal peut, si il estime qu’un délai raisonnable s’est écoulé, rendre sa décision. De plus, en cas d’urgence, le tribunal peut rendre une ordonnance provisoire ou une mesure de protection même avant l’expiration du délai de six mois.
Livraison par courrier
La notification par courrier est possible uniquement dans les États qui n’ont pas opposé leur objection à cette méthode en vertu de l’article 10(a) de la convention de La Haye sur la notification, et si la juridiction où le litige a lieu le permet en vertu de sa législation applicable.

Belgium’s position on Hague Service Convention (Convention of 15 November 1965)
The Convention of 15 November 1965 on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters (HCCH 1965 Service Convention) provides for the channels of transmission to be used when a judicial or extrajudicial document is to be transmitted from one Contracting Party to the Convention to another Contracting Party for service in the latter. It establishes a main channel of transmission via a designated Central Authority, as well as alternative channels of transmission.
Hague Service Convention deals primarily with the expedient transmission of documents; it does not address or comprise substantive rules relating to the actual service of process. The framework provided by the Convention is both efficient and effective – statistical data shows that 75% of requests are executed within two months.
Belgium is a signatory to the Hague Service Convention (Convention of 15 November 1965). The department responsible for the international judicial cooperation for the purpose of Hague Service Convention are Service Public Fédéral de la Justice and Service de coopération internationale civile.
Regarding the translation requirements set out in article 5, third paragraph of the Convention, the Government of Belgium wishes to draw attention to the fact that the Belgian Central Authority requires a judicial document that is to be served pursuant to article 5, first paragraph, (a) or (b), to be written in or translated into the official language or one of the official languages of the place where it is to be served (i.e. a Dutch-speaking region, a French-speaking region, the Brussels Capital region or a German-speaking region). The addressee’s postal code can be used to determine the language into which the document should be translated, viz.:
- 1000 to 1299 in French or Dutch;
- 1300 to 1499 in French;
- 1500 to 3999 in Dutch;
- 4000 to 4699 in French;
- 4700 to 4799 in German;
- 4800 to 7999 in French;
- 8000 to 9999 in Dutch.
Belgium’s position on Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters
Belgium is not a party to the Hague Evidence Convention. Belgium permits the taking of voluntary depositions of willing witnesses. It is possible to schedule a deposition at the Embassy. If the services of a U.S. consular officer are required to administer an oath to the witness, interpreter and stenographer, such arrangements must be made in advance with the U.S. embassy directly. See 22 CFR 22.1 for information about current consular fees related to obtaining evidence. While parties have the option to request that a Belgian court conduct the deposition, this would require transmittal of letters rogatory via diplomatic channels.
Taking Voluntary Depositions of Willing Witnesses
In civil cases, attorneys from abroad are allowed to depose anyone in Belgium provided that they are willing witnesses and provided that this procedure does not create procedural issues for the requesting party or implicates the legal rights of the requested party. In criminal cases, it is a fairly common practice to take voluntary depositions of witnesses (or often also victims) at a lawyer’s office.
Such requests for an ‘informal deposition’ are acceptable as long as the witness (1) is willing to testify; (2) is not (also) as suspect or accused involved in a related Belgian criminal case or wanted by a third country or prosecuted in a third country; and therefore (3) as long as the deposition has no influence on an ongoing Belgian criminal case.
Oral depositions or depositions on written questions may be taken by U.S. consular officers or by private attorneys from the United States or Belgium at the U.S. Embassy, or at another location such as a hotel or office, either on notice or pursuant to a commission. If the services of a U.S. consular officer are required to administer an oath to the witness, interpreter and stenographer, such arrangements must be made in advance with the U.S. embassy directly.

Belgium is a party to the Hague Convention Abolishing the Requirement for Legalization of Foreign Public Documents. Belgium’s competent authority for the Hague Apostille Convention will authenticate Belgian public documents with Apostilles.
