OVERVIEW

UAE is not a signatory to Hague Service Convention or Hague Evidence Convention. Service of process is governed by Federal Decree-Law No. (42) of 2022 Promulgating the Civil Procedure Code.

Formal Service

Formal service is only possible via letters rogatory which require translation of not only the documents but also the letter into Arabic language.

Informal Service

Process servers need to follow requirements of the Federal Decree-Law relating to service of process. Additionally, the specific requirements of each economic or free-zone must be complied-with to ensure proper service of documents. These zones have their own independent legal framework. Examples of such zones are ADGM, DIFC, JAFZA, RAKEZ etc. Technically, these zones operate similar to other global financial centres like the Cayman Islands, Singapore etc.

United Arab Emirates’s position on Hague Service Convention (Convention of 15 November 1965)

The Convention of 15 November 1965 on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters (HCCH 1965 Service Convention) provides for the channels of transmission to be used when a judicial or extrajudicial document is to be transmitted from one Contracting Party to the Convention to another Contracting Party for service in the latter. It establishes a main channel of transmission via a designated Central Authority, as well as alternative channels of transmission.

Hague Service Convention deals primarily with the expedient transmission of documents; it does not address or comprise substantive rules relating to the actual service of process. The framework provided by the Convention is both efficient and effective – statistical data shows that 75% of requests are executed within two months.

United Arab Emirates is not a signatory to the Hague Service Convention (Convention of 15 November 1965).
United Arab Emirates’s position on Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters

In civil or commercial matters, a judicial authority of a Contracting State may, in accordance with the provisions of the law of that State, request the competent authority of another Contracting State, by means of a Letter of Request, to obtain evidence, or to perform some other judicial act. A Letter shall not be used to obtain evidence which is not intended for use in judicial proceedings, commenced or contemplated. The expression “other judicial act” does not cover the service of judicial documents or the issuance of any process by which judgments or orders are executed or enforced, or orders for provisional or protective measures.

United Arab Emirates is not a signatory to the Hague Evidence Convention (Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters).
Transmission of Letters of Requests
Letters of Request are first sent to the Central Authority of the requesting state, before being sent to the Central Authority of United Arab Emirates.
The letters of request (formally known as Letters Rogatory) are sent by the requesting state via diplomatic channels to United Arab Emirates’s central authority.
United Arab Emirates accepts Letters of Requests written in the language of the requesting State accompanied by a translation into its local language.
