At Stellar Konsulting LLC (“Stellar Konsulting,” “we,” “our,” or “us”), we are committed to providing professional, responsive, and reliable process service, document delivery, and litigation support services.

We recognize that concerns or disagreements may occasionally arise. This Complaints & Dispute Resolution Policy explains how clients can raise concerns, how we review complaints, and the procedures available for resolving disputes.

1. Our Commitment to Clients

We aim to handle every assignment professionally, efficiently, and in accordance with applicable laws, regulations, court requirements, and procedures.

Our services may involve domestic or international process servers, foreign agents, courts, government authorities, Central Authorities, translators, couriers, investigators, and other third-party service providers. Because some aspects of an assignment may depend on parties outside our direct control, circumstances may occasionally result in delays, unsuccessful service, additional requirements, or other issues.

We encourage clients to contact us promptly whenever they have a concern so that we have an opportunity to review and address the matter.

2. What Is a Complaint?

A complaint is an expression of dissatisfaction regarding our services, communication, handling of an assignment, billing, administration, or another aspect of our relationship with a client.

Examples may include concerns about:

  • The handling of a service assignment;

  • Communication or response times;

  • Service attempts or service reports;

  • Documents or information provided to the client;

  • Fees or billing;

  • Delays;

  • Administrative errors;

  • Coordination with third-party service providers; or

  • Other aspects of the services provided by Stellar Konsulting.

A complaint does not necessarily mean that an error occurred. We will review the circumstances objectively and determine what action, if any, is appropriate.

3. How to Submit a Complaint

Complaints should preferably be submitted in writing so that we can properly review the matter.

Clients may submit complaints by email to:

Clients may also contact us using the telephone number or other contact information provided on our website.

When submitting a complaint, please provide as much relevant information as reasonably possible, including:

  • Client name;

  • Matter or order number, if available;

  • Date of the assignment;

  • Description of the concern;

  • Relevant documents or correspondence;

  • Names of any individuals or organizations involved; and

  • The resolution or corrective action being requested.

Providing complete information helps us investigate the matter efficiently.

4. Acknowledgment of Complaints

We will make reasonable efforts to acknowledge written complaints within 3 business days of receipt.

The acknowledgment may confirm that the complaint has been received and may request additional information if necessary.

The acknowledgment does not necessarily constitute a decision regarding the complaint.

5. Review and Investigation

We will review complaints in a fair and reasonable manner based on the information available to us.

Depending on the nature of the complaint, our review may include:

  • Reviewing the client’s instructions;

  • Reviewing documents submitted for the assignment;

  • Reviewing emails and other communications;

  • Reviewing service reports, affidavits, proofs of service, or other records;

  • Reviewing billing and payment records;

  • Communicating with employees or contractors involved in the matter;

  • Contacting a process server, foreign agent, translator, courier, investigator, or other service provider involved in the assignment; and

  • Reviewing applicable procedures, requirements, or circumstances affecting the assignment.

We may request additional information from the client during the review.

6. Complaints Involving Third-Party Service Providers

Some assignments require Stellar Konsulting to coordinate with independent or third-party service providers, including process servers, foreign agents, translators, couriers, investigators, attorneys, courts, government authorities, and other organizations.

Where a complaint relates to the actions or omissions of a third party, we will make reasonable efforts to investigate the matter and communicate relevant information to the client.

However, Stellar Konsulting cannot guarantee or control the actions, decisions, timelines, requirements, or availability of independent third parties or government authorities.

Where appropriate, we may request information or corrective action from the relevant third party.

7. Complaints Concerning International Services

International assignments may be subject to the laws and procedures of the destination country and may involve courts, Central Authorities, government agencies, foreign process servers, attorneys, or other local representatives.

International procedures may also involve requirements concerning:

  • Service methods;

  • Translations;

  • Authentication or legalization;

  • Court filings;

  • Government fees;

  • Central Authority procedures;

  • Local procedural requirements; and

  • Timeframes established by foreign authorities.

A delay, rejection, unsuccessful attempt, or requirement imposed by a foreign authority does not necessarily indicate that Stellar Konsulting acted improperly.

We will nevertheless review complaints concerning international assignments and explain, where reasonably possible, the circumstances affecting the matter.

8. Response to Complaints

After reviewing a complaint, we will provide a response explaining our findings and, where appropriate, any action that will be taken.

We generally aim to provide a substantive response within 10 business days after receiving the information necessary to complete the review.

Some complaints may require additional time because they involve third parties, foreign jurisdictions, government authorities, extensive records, or other circumstances outside our immediate control.

If additional time is required, we will make reasonable efforts to inform the client.

9. Possible Outcomes

Depending on the circumstances, a complaint may result in:

  • An explanation or clarification;

  • Correction of an administrative error;

  • Additional information or documentation;

  • A service update;

  • Further communication with a third-party service provider;

  • Corrective action where appropriate;

  • Additional service activity where agreed;

  • A billing adjustment where appropriate; or

  • No further action where the complaint is determined to be unfounded or where no corrective action is reasonably available.

Nothing in this Policy guarantees a particular outcome.

10. Billing and Payment Disputes

Questions concerning invoices, charges, payment processing, cancellations, or refunds should be raised with Stellar Konsulting as soon as possible.

Payment and refund disputes are also subject to the applicable provisions of our Terms & Conditions and Cancellation & Refund Policy.

Because work may begin immediately after payment is received, a disagreement concerning the outcome of an assignment does not automatically create a right to a refund.

Where a payment dispute, chargeback, or similar matter arises, Stellar Konsulting may review and provide relevant records reasonably necessary to establish the services performed, amounts charged, communications, and other facts relevant to resolving the dispute, subject to applicable law and confidentiality obligations.

11. Disputes Concerning Service Results

Stellar Konsulting does not guarantee that a recipient will be successfully served, located, contacted, or otherwise reached.

An assignment may be affected by incorrect addresses, recipient availability, changes in circumstances, local laws, court requirements, government procedures, access restrictions, holidays, delays, or other circumstances beyond our reasonable control.

An unsuccessful service attempt or an outcome that differs from the client’s expectations does not, by itself, establish that Stellar Konsulting failed to perform its obligations.

Where appropriate, we will explain the status of the assignment and discuss available options for further service attempts or alternative procedures.

12. Escalation

If a client is dissatisfied with the initial response to a complaint, the client may request that the matter be escalated for further internal review.

The escalation request should identify:

  • The original complaint;

  • The response received;

  • The specific issue that remains unresolved; and

  • Any additional information the client believes should be considered.

We will review the escalation request and determine whether additional investigation or clarification is appropriate.

13. Good-Faith Resolution

We encourage clients and Stellar Konsulting to communicate in good faith and make reasonable efforts to resolve complaints before pursuing formal dispute proceedings.

Clients are encouraged to provide accurate information, relevant documents, and a clear explanation of the issue so that we can properly evaluate the matter.

Likewise, Stellar Konsulting will make reasonable efforts to communicate the basis of its response and explain any relevant limitations or circumstances affecting the assignment.

14. Formal Disputes

If a complaint cannot be resolved through our internal complaint process, the parties may pursue any dispute-resolution mechanism available under the applicable agreement, law, or jurisdiction.

Nothing in this Policy prevents a client from exercising a legal right that cannot lawfully be waived or restricted.

The dispute-resolution provisions contained in the Stellar Konsulting Terms & Conditions may also apply to disputes arising from our services.

15. Legal and Regulatory Rights

This Policy is intended to establish an internal complaint-handling procedure. It does not replace or limit any rights, remedies, or procedures that may be available to a client under applicable law.

Nothing in this Policy is intended to exclude, restrict, or waive any consumer, contractual, statutory, or other legal right that cannot lawfully be excluded or waived.

16. Confidentiality

We will handle complaints and related information with reasonable care and in accordance with our Privacy Policy and applicable confidentiality obligations.

Where necessary to investigate or resolve a complaint, information may be shared with employees, contractors, service providers, payment processors, insurers, professional advisers, courts, government authorities, or other relevant parties, subject to applicable law.

17. Abusive or Bad-Faith Complaints

We will consider legitimate complaints seriously.

However, we reserve the right to limit communications concerning complaints that involve threats, harassment, abusive conduct, repeated submissions of substantially identical complaints, knowingly false information, or other conduct that interferes with our ability to operate or investigate matters fairly.

This does not prevent a client from exercising legitimate legal rights or submitting a genuine complaint.

18. No Waiver of Rights

Our review, investigation, communication, or participation in a complaint process does not constitute an admission of liability, wrongdoing, or breach of contract.

Any resolution offered in connection with a complaint will be considered on the specific facts and circumstances of that matter.

19. Relationship to Other Policies

This Complaints & Dispute Resolution Policy should be read together with Stellar Konsulting’s:

  • Terms & Conditions;

  • Cancellation & Refund Policy;

  • Privacy Policy;

  • Service Delivery Policy;

  • Cookie Policy; and

  • Other applicable policies published on this website.

If there is a conflict between this Policy and another policy, the applicable contractual terms or mandatory requirements of law will govern.

20. Changes to This Policy

Stellar Konsulting may update or modify this Complaints & Dispute Resolution Policy from time to time.

Changes become effective when the revised Policy is published on this website, unless otherwise stated.

The version of the Policy in effect at the time a complaint is submitted will generally apply to that complaint, subject to applicable law.
