Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Stellar Konsulting website, StellarKonsulting.com (the “Website”), and your purchase or use of services provided by Stellar Konsulting LLC (“Stellar Konsulting,” “we,” “us,” or “our”).

By accessing the Website, submitting an inquiry, requesting a quotation, placing an order, making a payment, or engaging Stellar Konsulting to provide services, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, you should not use the Website or engage our services.

1. Our Services

Stellar Konsulting provides process serving, international service of process, legal support, document-related services, court filing and related services, investigations, skip tracing, translation, courier and document delivery, and other services described on the Website or agreed upon with a client.

The specific services to be provided, applicable fees, and any special requirements may be described in a quotation, invoice, order confirmation, engagement communication, or other written communication issued by Stellar Konsulting.

Services may be performed directly by Stellar Konsulting or, where appropriate, through independent process servers, investigators, attorneys, couriers, translators, filing providers, government authorities, courts, or other third-party service providers.

2. No Guarantee of Outcome

Stellar Konsulting will use reasonable professional efforts to perform requested services diligently and lawfully.

However, we do not guarantee:

  • That a person will be located;

  • That documents will be successfully served;

  • That a recipient will accept documents;

  • That a court or government authority will accept a filing;

  • That a particular deadline will be met where circumstances are outside our reasonable control;

  • That a particular legal or procedural outcome will occur;

  • That an investigation will produce requested information;

  • That information obtained from third parties will be complete or accurate; or

  • That any service, report, document, or result will achieve a particular legal outcome.

Timeframes provided by Stellar Konsulting are estimates unless expressly stated otherwise in writing.

3. Client Responsibilities

The client is responsible for providing complete, accurate, and timely information and documents necessary for us to perform the requested services.

Depending on the assignment, this may include:

  • Correct names and addresses;

  • Legal documents and applicable attachments;

  • Case numbers and court information;

  • Relevant deadlines;

  • Contact information;

  • Instructions concerning service or filing;

  • Translations where required;

  • Special service instructions;

  • Information concerning known restrictions or requirements; and

  • Any other information reasonably necessary to complete the assignment.

The client is responsible for ensuring that the documents and information supplied to Stellar Konsulting are accurate and that the client has the legal right or authority to provide them.

Stellar Konsulting is not responsible for delays, additional costs, unsuccessful service, or other consequences resulting from inaccurate, incomplete, outdated, or late information supplied by the client.

4. Acceptance of Orders

An order or assignment may be accepted through written communication, electronic communication, telephone communication followed by confirmation, payment, invoice acceptance, or other reasonable means.

Once an assignment has been accepted and payment has been received, Stellar Konsulting may immediately begin work on the matter.

An accepted assignment may involve the allocation of personnel, process servers, investigators, translators, couriers, filing providers, or other resources.

5. Fees and Payment

The client agrees to pay the fees stated in the applicable quotation, invoice, payment request, or other written agreement.

Unless otherwise agreed in writing:

  • Payment is required before work begins;

  • Stellar Konsulting may require an advance payment or full payment before commencing services;

  • The client is responsible for all applicable service fees and approved third-party expenses;

  • Additional services or expenses outside the original scope may result in additional charges; and

  • The client remains responsible for valid charges incurred in connection with the assignment.

Credit-card or other payment-processing fees may be charged where disclosed at the time of payment.

6. Commencement of Work

Payment authorizes Stellar Konsulting to begin work on the client’s matter.

Upon receipt of payment, Stellar Konsulting may begin processing the assignment, communicating with service providers, reviewing documents, conducting research, arranging service attempts, making filings, arranging translations, dispatching documents, or performing other work necessary to fulfill the assignment.

For purposes of cancellation and refunds, work may be considered to have commenced when Stellar Konsulting or a service provider acting on its behalf begins any activity related to the client’s assignment.

7. Refunds and Cancellations

Cancellations and refunds are governed by Stellar Konsulting’s Refund & Cancellation Policy, which forms part of these Terms.

Because work may begin immediately after payment and may involve third-party resources or expenses, payments are non-refundable once work has commenced.

This includes situations in which:

  • The client changes their mind;

  • The client no longer requires the service;

  • The client requests that work stop after it has commenced;

  • The recipient cannot be located;

  • The recipient avoids service;

  • Service attempts are unsuccessful;

  • A court or authority does not accept a filing;

  • The matter is delayed for reasons outside Stellar Konsulting’s control; or

  • The client fails to provide additional information required to complete the assignment.

Third-party expenses incurred on behalf of the client may be non-refundable regardless of whether the assignment is ultimately completed.

8. International Services

Stellar Konsulting provides services in multiple jurisdictions and may coordinate with service providers, courts, governmental authorities, and other organizations in different countries.

International assignments may be subject to the laws, regulations, procedural requirements, service rules, translation requirements, fees, holidays, working practices, and restrictions of the country or jurisdiction in which services are performed.

Stellar Konsulting does not guarantee that the laws or procedures of another jurisdiction will permit a requested method of service or filing.

Where necessary, we may recommend or require additional documentation, translations, fees, legalization, apostilles, court orders, or other procedural steps.

9. Third-Party Service Providers

Stellar Konsulting may engage or coordinate with independent third parties to perform portions of an assignment.

These may include:

  • Process servers;

  • Investigators;

  • Couriers;

  • Translators;

  • Attorneys;

  • Filing services;

  • Government agencies;

  • Courts;

  • Local representatives; and

  • Other professional service providers.

We will use reasonable care in selecting or coordinating with third-party providers where appropriate.

However, Stellar Konsulting is not responsible for circumstances beyond our reasonable control arising from the independent actions, requirements, delays, errors, or decisions of third parties.

10. Documents and Client Materials

The client remains responsible for the accuracy and legal sufficiency of documents supplied to Stellar Konsulting.

Unless expressly agreed otherwise, Stellar Konsulting does not provide legal advice concerning whether a document is legally sufficient, whether a particular cause of action exists, whether a filing is legally appropriate, or whether a particular method of service will satisfy a court’s requirements.

We may identify apparent administrative or procedural issues, but such observations should not be considered legal advice.

11. Legal Advice Disclaimer

Stellar Konsulting is a legal-support and process-service provider. Unless expressly stated otherwise and performed by a properly licensed attorney, our services do not constitute the practice of law or legal advice.

You should consult qualified legal counsel regarding legal strategy, legal rights, legal obligations, filing requirements, jurisdictional issues, or other legal questions.

12. Service Reports and Proofs of Service

Where applicable, Stellar Konsulting may provide reports, affidavits, declarations, proofs of service, certificates, filing confirmations, or other documentation relating to an assignment.

The format and availability of such documentation may depend on the jurisdiction, service method, court requirements, and circumstances of the assignment.

We do not guarantee that a particular court or authority will accept a document or report.

13. Communication

We may communicate with clients by telephone, email, text message, fax, or other electronic or conventional communication methods concerning an assignment.

Service-related communications may include:

  • Order confirmations;

  • Payment information;

  • Requests for additional documents or information;

  • Service updates;

  • Status reports;

  • Filing updates;

  • Completion notices;

  • Invoices; and

  • Other communications reasonably related to the requested services.

Where marketing communications are sent, we will handle consent and opt-out requirements in accordance with applicable law.

14. Electronic Communications and Orders

Electronic communications may be used to communicate quotations, instructions, confirmations, invoices, and other information concerning an assignment.

Where permitted by applicable law, an electronic communication, electronic approval, or electronic acceptance may constitute evidence of the client’s instructions or agreement to proceed with services.

Clients should promptly notify Stellar Konsulting if they believe an instruction, invoice, or order has been issued incorrectly or without authorization.

15. Confidentiality and Privacy

We recognize the importance of protecting information provided in connection with our services.

Personal information is handled in accordance with our Privacy Policy.

Because our services may involve legal documents and information concerning individuals, businesses, addresses, court matters, and investigations, clients should provide only information reasonably necessary for the requested service.

Confidentiality obligations may be subject to legal requirements, court orders, governmental requests, dispute resolution, or other circumstances in which disclosure is legally permitted or required.

16. Intellectual Property

All content on the Website, including text, graphics, logos, images, page designs, layouts, icons, scripts, service descriptions, and other materials, is owned by or licensed to Stellar Konsulting and is protected by applicable intellectual-property laws.

Except as expressly permitted in writing, you may not:

  • Copy or reproduce Website content;

  • Modify or create derivative works from Website content;

  • Republish Website content;

  • Sell or commercially exploit Website content;

  • Use our trademarks or branding without authorization;

  • Scrape, harvest, or systematically collect Website content;

  • Use automated tools to extract Website information; or

17. Trademarks and Branding

Stellar Konsulting’s name, logos, service names, graphics, page headers, designs, and related branding may constitute trademarks, trade names, or trade dress of Stellar Konsulting.

You may not use Stellar Konsulting’s branding in a manner that suggests sponsorship, endorsement, affiliation, or authorization without our prior written consent.

Third-party trademarks appearing on the Website remain the property of their respective owners.

18. Acceptable Use of the Website

You agree not to use the Website to:

  • Violate any applicable law or regulation;

  • Interfere with Website operation;

  • Introduce malware, viruses, or harmful code;

  • Attempt unauthorized access to our systems;

  • Conduct automated scraping or data extraction;

  • Collect personal information without authorization;

  • Send spam or unsolicited communications;

  • Impersonate another person or organization; or

  • Engage in fraudulent, abusive, or unlawful activity.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Stellar Konsulting and its officers, directors, employees, agents, contractors, investigators, representatives, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the Website or services.

This may include, where permitted by law, loss of profits, loss of business opportunity, loss of income, loss of anticipated savings, loss of data, or other consequential losses.

To the fullest extent permitted by applicable law, Stellar Konsulting’s total aggregate liability arising from a particular assignment will not exceed the amount actually paid to Stellar Konsulting for the specific services giving rise to the claim.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

20. Events Beyond Our Reasonable Control

Stellar Konsulting is not responsible for delays, failures, or interruptions caused by circumstances beyond our reasonable control.

Such circumstances may include:

  • Natural disasters;

  • Severe weather;

  • War or civil unrest;

  • Government action;

  • Court closures;

  • Strikes;

  • Transportation disruptions;

  • Internet or telecommunications failures;

  • Cybersecurity incidents;

  • Public-health emergencies;

  • Changes in law or procedure;

  • Foreign-government restrictions;

  • Delays by courts or government agencies;

  • Delays by third-party providers; or

  • Other circumstances outside our reasonable control.

Where practical, we will make reasonable efforts to communicate material delays and determine whether the assignment can continue.

21. No Unlawful or Abusive Use

Clients may not use Stellar Konsulting’s services for unlawful purposes, harassment, intimidation, fraud, abuse, retaliation, or any purpose prohibited by applicable law.

We reserve the right to refuse, suspend, or terminate an assignment where we reasonably believe the requested service may involve unlawful conduct or may expose Stellar Konsulting or its service providers to unreasonable legal, safety, or operational risks.

22. Reviews, Feedback, and Public Statements

We value honest and lawful client feedback.

Nothing in these Terms prohibits a client from making truthful statements concerning their experience or from communicating with regulators, courts, attorneys, law-enforcement agencies, or other authorities where legally permitted.

Clients must not knowingly publish false statements, confidential information belonging to Stellar Konsulting, or information that is unlawful to disclose.

Nothing in this section limits any rights that cannot lawfully be waived or restricted.

23. Disputes and Complaints

If you have a concern regarding our services, we encourage you to contact us first so that we have an opportunity to investigate and address the matter.

Complaints will be handled in accordance with our Complaints & Dispute Resolution Policy.

Clients should provide sufficient information for us to identify the assignment and understand the nature of the concern.

Nothing in these Terms prevents a party from exercising rights that cannot lawfully be waived.

24. Governing Law

These Terms shall be governed by applicable law as determined by the appropriate jurisdiction and without giving effect to conflict-of-law principles to the extent permitted by law.

Because Stellar Konsulting provides services internationally, the laws and procedural requirements applicable to a particular assignment may vary depending on the location and nature of the services.

Nothing in these Terms is intended to deprive a consumer or other party of mandatory rights or protections that apply under the law of the jurisdiction that cannot lawfully be excluded.

25. Changes to These Terms

Stellar Konsulting may update these Terms from time to time to reflect changes to our services, business practices, technology, legal requirements, or Website.

The updated Terms will be posted on the Website with a revised effective date.

Your continued use of the Website or continued engagement of our services after an update may constitute acceptance of the updated Terms to the extent permitted by applicable law.

26. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.

If modification is not possible, the affected provision will be severed, and the remaining provisions will continue in effect.

27. Entire Agreement

These Terms, together with any applicable quotation, invoice, service agreement, order confirmation, Privacy Policy, Refund & Cancellation Policy, Service Delivery Policy, Complaints & Dispute Resolution Policy, and other policies expressly incorporated by reference, constitute the agreement governing the applicable services, unless a separate written agreement expressly supersedes these Terms.

If there is a conflict between these Terms and a specific written service agreement signed by both parties, the specific written agreement will control to the extent of the conflict.
